DOJ gives Harley-Davidson $3 million discount on pollution fine

Harley-Davidson is struggling (198 layoffs just announced in our local {Milwaukee} paper).

DOJ threw them a bone.

I'm not sure they're "struggling". Yes, they suffered a 6% drop in revenues (or earnings, can't recall exactly) earlier this year it was reported this week. Resulted in immediate gassing (pun intended) of 198 people. Nice.

Some folks might interpret that as H-D's effort to reduce air pollution - 198 people won't be driving to work anytime soon.

HD routinely shifts employment levels at it's various plants during labor contract negotiations. The bigger issue is how a company with ~2x the worldwide unit sales of BMW Motorrad and ~1.5x the unit sales of KTM can continually use the "poor little ol'me" defense.
