2016 C650 Sport just blew engine due to timing chain failure. Do I have any recourse?

My 2016 C 650 Sport with 9K miles just blew the engine due to the timing chain failure. BMW of Burbank wants $9k to install a new engine and says I have no recourse. I have had the scooter since it was new. Just did a ton of recent service on it. All throughout the ownership all required maintenance at the BMW dealer. From day 1 of ownership, 7+ years ago, I have been reporting a strange rattle in the engine. I had another scooter before and know how they should sound. After 1.5 years of ownership, the noise was documented multiple times throughout my service history. I was trying to get my Aegis extended warranty to cover it when it was in the shop in Jan and then May, but they wouldn't. Took it to BMW of Burbank twice who had the engine out for over a month. Then it blew up last week. Aegis is declaring it a total loss and trying to pay me way too little. There is was a campaign from BMW but allegedly not on my VIN. Totally sucks. I don't think I will find another Valencia Orange replacement. And I don't want a replacement. I want mine! Someone in the Motorrad forum told me to contact Long Beach BMW, Brown BMW in Pomona, Irv Seaver BMW in Orange, or lastly Scooter Dynasty to reapir it. I thought I would try to push BMW of Burbank one more time. Do I have any other recourse? Thanks in advance--Skip in Hollywood
 
Skip, I had a 2013 C650GT (thus the moniker) soon after purchase mine started to rattle like it was grinding marbles it wouldn’t do it until it warmed up and was diagnosed as timing chain tensioner. At that time was early in the production life cycle of these bikes and they couldn’t get parts so I worked with my dealer for a settlement with BMW of NA and they purchased the bike back. Maybe others will chime in on their issues but it sounds like you have the “gripe” duly recorded in the service records, you do not note whether it was noted with you initial 36 month warranty period. I would think if you did with all of the subsequent service and work they would have stepped up if that were the case. Recognizing the low mileage it may not have occurred in the warranty but you might be able to see if BMW NA will help you out if this is a common issue noting the due diligence you demonstrated working to identify and correct the issue with “BMW” Certified Technicians. You may want to also contact an attorney with expertise in this area. Sorry to hear of your troubles.

Thank you so much. Yes. Definitely was under warranty when I started reporting it. They started documenting this after 1.5 years of ownership even though I reported it from day 1. It is documented through out the records since then. On the phone with BMW Motorrad customer service right now. She is taking notes and escalating it. Says I will get a call back within 5 business days. Thanks for wishing me luck. I am sure I will need it!
 
If they approve the repairs, see if you can opt for the dealer of your choice for repairs. If Burbank wasn't interested in helping escalate it (they would have been paid either way if approved), not sure how they will feel about being told to do it by the mothership...

BMW of NA offered me $1,500 off of a new scooter or toward the now $11,500 repair. Doesn't seem like they are going to budge beyond that. Contacting lemon law attorneys but I doubt it will be worth their time. I don't understand why so many others were recalled but mine wasn't.
 
Too bad CA doesn't cover m/c's under our Lemon Law. Maybe some recourse thru the Magnuson-Moss Warranty Act (federal law governing consumer product warranties)?
