I Think I'm Fed-Up with BMW

My Scooter has been in the shop going on 60 days. I call the 800-831-1117 number to see what could be done, the person on the other end transfered me to a specialist his name is Zack G. Last week monday, Zack G. ask me, do you want your money back? I said "no, but after 50 days, give me a scoter to ride, replace it" Zack G. said he will look into it and he will call me back in a few days Thursday or Friday he even gave me his extention number.

No call from Zack G. Thursday so I call him, I get a recording, I left a message to call me back. Friday no call from Zack G. so I call him, I get a recording "please leave a message" I leave a message for him to call me back, no luck there. I call today today no answer from Zack G. now I get the hint. There is no support from BMW so I will not support BMW, BMW just wants me to go away. I won't stop here I'm not finish yet.........

Today Update Oct 18, 2013 I'm on day 60 ( DID YOU HEAR THAT BMW, DAY 60 ) (REPLACE MY LEMON C650GT BMW) The case has been turned over to a guy name Mark at BMW, Zack G. is no longer on the case. I really believe there just trying to stall untill the repairs are made. I know about the " LEMON LAW" here in California. BMW told me that if I bring in an attorney into this, then they drop the case and I will get no help from BMW.

I once had a similar problem with a defective differential on a new Ford F-150. The dealer messed it up and pretended they couldn't hear a obvious whine. They said it had to get worse and that calling Ford would do not good. I knew they were correct. I wrote a letter and explained my problem. I got a call about a week later with a promise that they would check into it and get back with me in 2 or 3 days. I waited a week and mailed another letter with the names of who I had talked with along with a copy of the original letter. Again, I got a call with a promise to check on the problem and call me back. After the promised call never came, I wrote a third letter with names, dates, times and sent a copy of the previous letters. A few days later, I got a call from a manager in Florida who sent me to a different dealer of my choice, promise of a rental vehicle plus expenses for taking it and picking it up. The problem was immediately fixed and it is still good 9 years later (and the parts that weren't available got there in 2 days).

I learned the effectiveness of well documented snail mail by occasionally being the target as an insurance adjuster for 31 years. When you have to settle claims based on management requirements that you don't necessarily agree with and then have management ignore those requirements to shut up a customer, it gets frustrating.

Have you had a serious talk with general manager of the selling dealer, unless they are total jerks I would think its in their best interest to keep the customer happy, if not start talking LEMON LAW, check first if applies to motorcycles in your state though.

Wonder why you didn't take a refund?

Could have bought another if you wanted or done something different.

Might have been a strategic error. :dunno
 
Where are you? Are you within the small claims limit of your state or willing to live with that limit as a recovery? If so, you might just bring a case, as a judge, when presented with the bike being out of service for over two months with no repair in sight, no loaner, and no compensation, may very well agree that the warranty has been breached. DISCLAIMER: Not legal advice.
